휴대용게임기 닌텐도 DS라이트의 발목을 잡아온 ‘R4’ 등 게임복제물은 위법이라는 법원의 판결이 나왔다. 그동안 불법물이냐 아니냐는 논란이 일었던 ‘R4’ 등에 대한 위법 판결은 이번이 처음이다. 닌텐도는 지난해 초 닌텐도 DS라이트(NDSL)를 국내에 출시, 140만대 넘게 팔았지만 불법복제칩으로 인해 게임소프트웨어가 팔리지 않아 막대한 피해를 봤다. 이번 판결로 R4 등을 유통하는 업체에 강력한 제재 요청을 할 수 있는 법적 근거도 생기게 됐다.

한국닌텐도(대표 코다 미네오)는 “NDSL의 기술적 보호조치를 회피하는 R4, DSTT 등 불법 장치를 수입.판매하려던 업자에 대해, 컴퓨터프로그램보호법 위반에 근거한 형사처벌(벌금 약식명령)이 확정됐다”고 11일 밝혔다.

NDSL은 한국을 포함한 전 세계에서 수천만대가 팔린 닌텐도의 게임기. 한국 등지에서 R4 불법복제물로 인해 게임소프트웨어가 게임기보다 적게 팔리는 기현상에 시달려왔다. 이에 한국법인은 전사적 차원에서 불법복제와의 전쟁을 선포하고, 형사고소 등으로 강경하게 대응해왔다.

서울 남부지법은 컴퓨터프로그램보호법에 근거, R4 등 불법복제칩이 위법이라고 판단해 형사처벌을 확정했다. 컴퓨터프로그램보호법 제30조 제2항에서 “누구든지 상당히 기술적 보호조치를 무력화하는 기기, 장치, 부품 등을 제조 혹은 수입하거나 공중에게 양도, 대여 또는 유통해서는 안 된다”고 규정하고 있다.

한국 관세청은 한국닌텐도의 요청을 받아들여, 해당업자들의 수입신고화물에 대해 통관을 보류하고 심사해, 검찰청을 통해 컴퓨터프로그램보호법 위반 혐의로 법원에 약식기소했다.

코다 미네오 한국닌텐도 대표는 “R4 불법복제장치의 수입.판매를 비롯한 각종 위법행위에 대해서 계속해서 단호한 자세로 법적조치를 강구할 방침”이라고 말했다.

한편 한국닌텐도는 인터넷에서 불법복제게임을 올리고 있는 네티즌들과 해당 온라인사이트들도 형사 고소해, 재판을 진행하고 있다.
